Terms of Service
Effective as of April 20, 2025.
These Terms of Service (“Terms”) govern your access to and use of our website and services, including the production of tribute videos offered by Legacy Reflection Studios (“we”, “us”, “our”). By accessing our site or using our services, you agree to be bound by these Terms.
1. For Website Visitors
1.1 Use of Website
By using our website, you agree to access it only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their enjoyment of the site.
1.2 Intellectual Property
All content on this website — including text, images, logos, videos, and branding — is the property of Legacy Reflection Studios or its licensors and may not be reproduced, republished, or distributed without our written permission.
2. For Individual Customers
2.1 Tribute Video Production
Our tribute video services are personalized and custom-built using the media (photos, videos, audio, text) you or your representative provide. You are solely responsible for ensuring that you have the legal right to share and use all submitted content.
2.2 Ownership and Licensing
You retain ownership of the personal media you submit. By providing content, you grant Legacy Reflection Studios a non-exclusive, royalty-free license to use, edit, and incorporate the material into your final tribute video.
The final tribute video is licensed for personal, non-commercial use.
2.3 Music and Third-Party Content
All tribute videos include licensed royalty-free music. This music may not be extracted, reused, or redistributed in any format. Requests for commercial music must be accompanied by valid proof of licensing; otherwise, we will not include copyrighted music in any video.
2.4 Revisions
Your service package may include limited revisions. Minor changes (e.g., typo corrections or image swaps) are generally allowed within a short window. Major revisions or re-edits beyond the included scope may incur additional fees.
2.5 Refund Policy
Because each tribute video is custom-built, all sales are final. We do not offer refunds or returns.
If you cancel your order before production has started, a partial refund may be granted at our sole discretion. Once editing begins, no refunds will be issued under any circumstance.
3. For Funeral Homes and Partners
3.1 Service Relationship
When a funeral home contracts with Legacy Reflection Studios, the funeral home is considered our client. Payment is due directly from the funeral home, regardless of how or whether they invoice their end customer.
3.2 Ownership and Usage Rights
You retain full ownership of the photos, videos, and other personal media you provide, as well as the final tribute video created for you. Legacy Reflection Studios does not claim ownership of your story.
We may request permission to use a short, anonymized clip (with no identifying information) for our portfolio or marketing. This will only be done with your written consent.
3.3 Payment Terms
A 50% deposit is due at the time of the request submission. The remaining 50% is due upon delivery of the final video. Work will not begin until the initial deposit is received. Final video files will not be released until full payment has been received. Payment is the responsibility of the funeral home, regardless of reimbursement arrangements with their clients.
4. General Terms for All Users
4.1 Limitation of Liability
To the fullest extent permitted by law, Legacy Reflection Studios is not liable for indirect, incidental, special, or consequential damages — including emotional distress — arising from your use or inability to use our services.
4.2 Indemnification
You agree to indemnify and hold harmless Legacy Reflection Studios, its staff, affiliates, and agents from any claims, losses, or damages resulting from your violation of these Terms or misuse of our services.
4.3 Privacy
Your privacy matters to us. Please see our [Privacy Policy] for details on how your data is collected, stored, and protected.
4.4 Dispute Resolution
Any disputes arising from our services will be governed by the laws of Ontario, Canada. In the unlikely event of a disagreement, we’ll aim to resolve it amicably. If needed, both parties agree to pursue resolution through arbitration rather than court proceedings.
4.5 Changes to Terms
These Terms may be updated from time to time. Continued use of our website or services indicates your agreement with the most current version.
